Right, so the person I intend to overtake has to be going slower than me so I can overtake them as I'm going faster than the person whom I'm overtaking as they are going slower?

Anyway. Overtakeing Mr 60 mph in lane 3 on the inside when lanes 1&2 are completely empty isn't filtering.
Filtering along the A12 between lanes 2&3 when the traffic is doing 20mph.nose to tail is not illegal.

You should be in lane 1 "keep to the near side line unless overtaking".

I would go by in lane 1 and if stopped I would argue that my lane was moving faster (70mph) than lane 3

Filtering between lanes 2&3 when doing 20 mph is not legal, as it is undertaking, but it is accepted practice.

If the traffic is moving at 50 mph you risk some copper knicking you and of course the personal risk is much greater when it goes wrong.

The speed that you are travelling at doesn't really affect the likelihood of something happening but the consequences are far greater

    Filtering is not illegal.
    They don't make things legal

What they do is prohibit you from doing things.
It's not "legal" to go 60mph in a 70mph limit.
You're not looking at it from the right perspective.

Oh sorry to inform you but in lane one was a milk float doing 20 mph in the first example.

You might be, some of us would notice these things and plan ahead...

You really should be more precise in your scenarios.

As you obviously didn't know, the law prohibits milk floats from motorways.

You didn't read my earlier post. Filtering is not a legal definition.

Filtering is accepted practice under certain conditions.

But, it is always illegal to overtake a vehicle on the near side. Unless (this is for kwacky) the lane you are IN is moving faster.

Between the lanes it is illegal, No matter what, it's just that it's accepted practice in the UK at low speed and police are not usually going to stop you.

It's only been in recent years that you would get a claim in your favour for filtering on the outside. Do it between the lanes on multi lane road and you would stand little chance of succeeding in a claim if you get knocked off.

    The A12 isn't a motorway.

Post a link to were it states that filtering between lanes is illegal.

The filtering debate could go back & forth indefinitely.
It happens all the time on the US forums....everyone thinks Californians are crazy for doing it, we see no problem with it. Then again we have HOV lanes, and bikes can slip right between that and the #1 lane.

    PS....HOV - "High Occupancy Vehicle"....those lanes rock!!

Have you see that episode of Curb when he hires a hooker so he can use the lane?

Actually sorta believable too....I used to take my last helper up to LA with me even if I didn't need him, just to not sit in traffic all day. I'd have to pay him something, but as long as the job was out of the way I didn't care.
